These Terms and Conditions (“Terms”, “Agreement”) govern your use of our website (apexterrazzo.com) (the “Site”), and any services provided by us (the “Company”, “we”, “us”, “our”). By accessing or using the Site, or requesting our services, you accept and agree to be bound by these Terms. Please read them carefully.

1. Definitions & Interpretation

• “Client”, “You”, “Your” — any person or entity visiting the Site or engaging with us for services.

• “Services” — all services offered by us, including but not limited to terrazzo flooring, finishing works, quotes, project management, consultations, and related services.

• “Site” — apexterrazzo.com and all associated pages or subdomains.

• “Content” — all text, images, graphics, designs, and other materials on the Site.
   

2. Use of the Site

• The Site and its Content are provided for general information about our services. Use of the Site does not automatically create a contract for services.

• You agree to use the Site lawfully and not to misuse it (e.g. no hacking attempts, no unauthorized copying of materials, no submission of malicious content).

• All Content on the Site, text, images, and logos, is owned or licensed by Apex Terrazzo. You may not reproduce, copy, republish, or otherwise use any Content without our prior written consent.
   

3. Services, Quotes & Estimates

• Any quote, estimate or proposal provided by us is valid for 30 days, unless otherwise noted.

• Quotes are based on the information you provide. If you change the scope, materials, or specifications, additional costs may apply.

• All payments must be made as per the payment schedule specified in the quote or contract. If a deposit is required, work will not commence until the deposit is received.

• We reserve the right to refuse or postpone work if payments are late or if site conditions are unsuitable or unsafe.
   

4. Payment, Prices & Taxes

• All prices are quoted in USD and exclude taxes unless explicitly stated.

• Payment methods accepted: Bank transfer or wire

• You are responsible for providing accurate billing information. If payment fails due to incorrect information, you remain responsible for payment and any additional costs incurred.
   

5. Warranty, Quality and Limitations

• We aim to deliver services at a high quality and with professionalism. If you believe the workmanship is defective, you must notify us in writing within 30 days of completion, which includes a 1-year warranty. A 2-3 year extension with associated maintenance can be added and needs to be discussed separately per project.

• We may rectify defects at our discretion. If rectification is not possible or accepted, liability is limited to correcting the issue or, at our discretion, a refund of amounts paid for the defective part of the work.

• Except as stated, we make no other warranties (express or implied) about the services, materials, or outcomes.
   

6. Liability, Indemnity & Disclaimers

• To the maximum extent permitted by law, Apex Terrazzo is not liable for any indirect, incidental, special or consequential damages, including loss of profits, loss of data, or delays, arising from use of the Site or from services rendered.

• You indemnify Apex Terrazzo against any claims, losses, damages or expenses (including legal fees) arising out of your misuse of the Site, your breach of these Terms, or negligence on your part.
   

7. Intellectual Property

• All intellectual property rights in Content on the Site belong to Apex Terrazzo or its licensors.

• You may view and print pages from the Site for your personal, non-commercial use only. Any other use (reproduction, distribution, modification, publication) requires our prior written permission.
   

8. Termination and Cancellation

• We reserve the right to cancel or suspend a project at any time if you breach these Terms (e.g. non-payment, misuse of the Site, refusal to allow access).

• Upon cancellation, you may be liable for costs incurred up to that point, including materials, labour, and other expenses.

• If you wish to cancel or withdraw a service request after acceptance of the quote/contract, you must notify us in writing. Depending on timing, a cancellation fee may apply.
   

9. Changes to Terms

• We may update these Terms at any time by publishing a new version on the Site. The “Last updated” date will reflect changes.

• Continued use of the Site or accepting our services after changes constitutes acceptance of the updated Terms.
   

10. Governing Law & Dispute Resolution

• These Terms and any contract for services shall be governed by the laws of Florida.

• Any disputes arising in connection with these Terms or our services shall be resolved by mutual consultation and agreement. If that fails, disputes may be referred to mediation, arbitration or court (depending on the parties’ agreement).
